Charge Savvy LLC Privacy Policy.
Introduction
This Privacy Policy (“Policy”) explains how Charge Savvy LLC and its mobile applications (collectively referred to as “we,” “us,” the “Application” or “our”) collects, stores, uses, and shares your personal information as part of providing our Services.
This Policy applies to:
- Merchants: Businesses that have contracted with Charge Savvy to provide the Services within their establishment;
- Merchant Employees: employees of our Merchants that use the Services;
- Guests: Individuals who use the Services at one of our Merchant’s establishments;
- Independent Contractors: User whose services are used by the Merchant; and
- Website Visitors: Individuals who visit our website.
Please note that our Merchants are independent third parties with their own business practices and policies, separate from Charge Savvy. Therefore, unless specified in this Policy, we are not responsible for their privacy policies or data practices. If you are a Merchant Employee, your employer must provide you with any additional information regarding its privacy practices beyond this Policy.
By using the Services or providing us with your personal information, you acknowledge that your personal information will be processed and used in the manner set out in this Policy.

This website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy policy of every website you visit.
Children
Our website and Services are not directed to children under 18, and we do not knowingly collect or store any personal information about persons under the age of 18. If we learn that we have collected personal information of a child under 18, we will take steps to delete such information from our systems as soon as practicable.

Third Party Information Collection
When you use our Services, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include analytics companies.
If You Fail to Provide Personal information
Where we need to collect personal information by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.
Disclosure of Your Personal information
When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.
We require all third parties to respect the security of your personal information and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal information for their own purposes and only permit them to process your personal information for specified purposes and in accordance with our instructions.

Transfers of Personal Information
We may transfer personal information that we collect or that you provide us to service providers, and other third parties we use to support the App (such as analytics providers that assist us with App improvement and optimization) and who are contractually obligated to keep personal information confidential, to use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this policy.

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. They will only process your personal information on our instructions, and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We will only retain your personal information for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. If you are a U.S resident, you have the following rights:
- The right to access a copy of the personal information Charge Savvy has collected about me.
- The right to know the categories of personal information collected about me, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting personal information, the categories of third parties with whom Charge Savvy shares personal information, and the specific pieces of personal information collected about me.
- The right to delete the personal information Charge Savvy has collected from me.
- The right to correct inaccurate personal information that we maintain about you.
- The right to limit our use and disclosure of sensitive personal information.
If you are an Oregon resident, you may request a list of specific third parties with whom we have shared your personal information.
Nevada provides its residents with a limited right to opt-out of certain personal information sales. However, please know that we do not currently sell data triggering the statute’s opt-out requirements.
How to Exercise Your Rights

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Describe your request with sufficient detail that allows us to understand, evaluate, and respond to it properly.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.
We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
Other California Privacy Rights
California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Websites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. This Privacy Policy may be updated from time to time. If we make material changes to how we process your personal information, we will notify you by email the email address specified in your account or through a notice published in the Application. This version was last updated on August 9, 2024. We reserve the right to amend this Privacy Policy at our discretion and at any time. Your continued use of our Services following the posting of changes constitutes your acceptance of such changes.
